2. Scope of Services

• Sales of Properties and Land:Assisting clients in the purchase and sale of international properties, particularly in Bulgaria.

All services are subject to written agreements detailing specific fees, terms and conditions.

3. Fees and Charges

• Fixed Fee for Properties and Land up to €50,000:
  • A fixed fee of €1,500applies to properties and land with a purchase price up to €50,000.
• Percentage Fee for Properties and Land Above €50,000:
  • For properties and land priced above €50,000, a fee of 3%of the advertised purchase price applies.
• Payment Timing:
  • The fee must be paid upfront before services commence, as outlined in the Agreement.
• Payment Method:
  • Payments can be made via bank transfer or cash.

4. Refund Clause

• Upfront Commission Fees:
  • All upfront commission fees paid to Adel Real Estate Ltd. are non-refundable. By agreeing to our terms and conditions, the client acknowledges and accepts that these fees are used to cover administrative costs, marketing efforts and professional services rendered during the course of our engagement, regardless of whether the transaction is successfully completed.
• Client Cancellation:
  • If the client decides not to proceed with purchasing a property, any fees already paid to Adel Real Estate Ltd. will notbe refunded under any circumstances.

5. Client Obligations

Clients engaging with the Company agree to:

• Provide accurate and complete information about properties, financial details, and identification documents.
• Comply with all legal requirements related to property sales, rentals, and financial transactions.
• Notify the Company promptly of any changes to personal or property details.

Failure to comply with these obligations may result in delays, additional costs, or termination of the agreement.

6. Anti-Money Laundering Compliance

The Company adheres to the Money Laundering, Terrorist Financing, and Transfer of Funds (Information on the Payer) Regulations 2017.

• Identification Requirements:
  • All clients must provide valid photo identification (e.g., passport) and proof of address (e.g., utility bill).
• Enhanced Due Diligence:
  • Additional checks may be required for high-risk transactions.
• Record Keeping
  • Records of transactions and client identification will be retained for at least five years.

7. Reporting Obligations:

• The Company is required to report suspicious activity to the appropriate authorities.

Failure to provide the necessary documentation will prevent the Company from proceeding with services.

8. Property Listings and Advertising

• Accuracy of Listings:
  • The Company strives to ensure that all property descriptions, images, and details are accurate.
• Property Viewings:
  • Viewings are subject to prior arrangement and availability.
• Marketing Permissions:
  • Clients authorize the Company to market and advertise properties as agreed in the written service contract.

9. Liability

• Exclusions:
  • The Company is not liable for losses resulting from inaccurate information provided by clients or third parties.
  • The Company is not responsible for unforeseen delays caused by legal, financial or logistical issues beyond its control.
• Limitations:
  • Liability is limited to the total fees paid to the Company for the specific service.

10. Cancellation and Termination

• Cancellation by Client:
  • Clients may cancel services with written notice, subject to any cancellation fees agreed upon in the service contract.
• Termination by the Company:
  • The Company reserves the right to terminate services if the client breaches these Terms and Conditions or applicable laws.

11. Privacy and Data Protection

• The Company processes personal data in compliance with the UK GDPRand the Data Protection Act 2018.
• Clients’ personal information will only be used for purposes necessary to provide services and comply with legal obligations.
• Clients have the right to access, correct or request deletion of their data.
• Information We Collect- name, address, contact details and financial information for property transactions.
• Data Usage– to facilitate property transactions; to comply with legal obligations, including anti-money laundering checks; for marketing purposes, with your explicit consent.
• Data Sharing– we do not sell personal data.

12. Use of Digital Channels

• Website Usage:
  • By using our website, including the social media platforms, users agree to use them solely for lawful purposes related to property services.
• Email Communications:
  • By providing your email address, you consent to receive service-related communications. Marketing emails will only be sent with your consent.
• Privacy:
  • Use of digital channels is subject to our Privacy Policy, which governs the collection and use of user data.

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts in England.
